Terms of Service
These Terms govern your access to and use of 3DP Ocean, a platform that lets you generate, browse, and download 3D models. By creating an account or using the service you agree to these Terms. If you don't agree, don't use the service.
1. Your account
You must be at least 13 years old to use 3DP Ocean (16 in the EEA / UK). You're responsible for keeping your sign-in credentials secure and for any activity that happens under your account. Notify support if you suspect unauthorized access.
One person per account. Sharing an account, or selling / transferring account access, isn't allowed.
2. The service
3DP Ocean takes an image you upload and produces a 3D model from it, optionally enhanced, cleaned, and resized for print. You can preview, download, and (where the model is yours) publish to Community models. Service availability, processing time, and AI-generation quality may vary; we work hard to make them excellent but we don't guarantee a specific output or uptime SLA on free tiers.
3. Acceptable use
You agree not to upload, generate, or distribute content that violates our Content Policy. Without limiting that policy, you must not:
- Infringe anyone's intellectual property, trademarks, or right of publicity.
- Generate sexual content involving real or apparent minors. Ever.
- Generate models of identifiable real people without their consent.
- Generate working firearms, weapons, or functional dangerous-goods.
- Reverse-engineer, scrape, or attempt to extract our models, prompts, or AI provider keys.
- Use the service to train competing AI models.
- Interfere with the service, other users' accounts, or our infrastructure.
We may suspend or terminate accounts that violate these rules, including a permanent ban for repeat or severe violations.
4. Intellectual property
What you upload stays yours. You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, transform, and display your uploads for the purpose of providing the service, including running them through our AI providers (image enhancement and 3D generation) and rendering preview thumbnails.
What the AI generates from your inputs is licensed to you under our License Agreement, and critically, the same license applies whether you're on a free or paid plan. Some platforms in this category take ownership of free users' outputs or require attribution back to the platform; we don't. Free users own their generations the same as paid users. You can use them for personal and commercial 3D printing.
Two things you can't do, regardless of plan: (a) resell the raw mesh as-is on a different 3D marketplace (Sketchfab, CGTrader, Cults3D, etc.) without significant modification, which protects our creator ecosystem from automated re-uploads; (b) claim exclusive copyright over AI-generated geometry in jurisdictions where AI outputs aren't eligible for protection (currently the US Copyright Office position for purely AI-generated work).
The 3DP Ocean platform itself belongs to 3DP Ocean and is protected by copyright, trademark, and other laws. That covers the website, branding, interface, code, design system, curated catalog (Gold-marked models), and any pre-rendered assets we publish.
4.1. AI output disclaimer
AI generation models are trained on large datasets and may, in rare cases, produce outputs that resemble or partially reproduce copyrighted material from their training data. We take no responsibility for AI outputs that infringe third-party intellectual property, and we don't warrant that any specific generation is clean of such resemblance. You are responsible for clearing rights before using a generated model in commercial work where IP cleanliness matters (e.g. resale, licensing, mass production).
Our standing commitment on AI training is in Privacy Policy section 4: we do not use your uploads or generations to train any AI model, on any plan.
5. Subscriptions, credits, and payments
Paid plans and credit packages are billed through our payment processor (Stripe). Credits are valid for 12 months from the day they reach your account, whether you bought them or were given them. We tell you 30, 20, 10 and 3 days before they go, and credits expiring soonest are always spent first, so you never lose credits while newer ones sit unused. Rewards you earn from sharing are not credits and do not expire.
Auto-renewal notice: if you subscribe to a paid plan, your subscription renews automatically at the end of each billing period at the then-current price for that plan, charged to your saved payment method, until you cancel from Billing settings. You can cancel any time and keep access until the end of the period you've already paid for.
Prices, credit-to-action ratios, and feature inclusions may change. We give at least 30 days' notice for any change that increases the price of an active subscription or reduces the value of unspent credits.
Refunds. If a generation fails, we put the credits back automatically — you do not need to ask. If a generation finishes but the result is unusable, contact us and we will refund those credits. Unused credit packages are refundable within 14 days of purchase if no credits have been spent. Subscriptions are not refunded for the current billing period, but you can cancel at any time and keep access until that period ends. Generating a model costs us money each time it runs, so a re-run costs credits again, in the same way as every other AI service.
Your rights under consumer law come first. Nothing in these Terms excludes, restricts or changes any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded by agreement. Where a law like that gives you a right, that right applies no matter what the rest of this section says.
6. Community models
Publishing a model to Community models grants other users a license to download and use it under our standard license terms (see the Licenses page). Models are not sold for money: downloading another creator's model costs the person downloading it credits, and publishing does not earn the creator a payment.
You're responsible for ensuring you have the rights to everything you publish. If we receive a credible takedown notice (see our DMCA process), we may remove the listing without prior notice.
7. Termination
You can delete your account at any time from Account settings. We can suspend or terminate your account for violations of these Terms, the Content Policy, abuse of the service, or where required by law. On termination, your public listings may be removed and unpaid credits forfeited.
8. Warranties and disclaimers
The service is provided "as is" and "as available." We don't warrant that it will be uninterrupted, error-free, or that AI-generated output will be suitable for any particular purpose, including 3D printing, commercial production, or use with any specific slicer / printer combination. To the maximum extent permitted by law we disclaim all implied warranties.
9. Limitation of liability
To the maximum extent permitted by law, 3DP Ocean's aggregate liability for any claim arising out of or related to the service is limited to the amount you paid us in the twelve months preceding the claim, or USD 100, whichever is greater. We're not liable for indirect, incidental, consequential, special, or punitive damages, lost profits, or lost data.
10. Indemnification
You agree to defend, indemnify, and hold harmless 3DP Ocean, its affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from:
- The input images, prompts, or other content you upload or transmit through the service.
- The 3D models, textures, or other outputs you generate, download, or distribute through the service.
- Any third-party intellectual-property claim that arises from your inputs or outputs, including resemblance between an AI generation and existing copyrighted work.
- Your use of generated models in commercial products without clearing the necessary rights (see section 4.1).
- Your violation of these Terms, the Content Policy, or any applicable law.
- Your violation of the rights of any third party.
This indemnification does not apply to claims caused by our own gross negligence, willful misconduct, or fraud. We may, at our option, assume the defence of any claim subject to this indemnification, in which case you will cooperate with us in good faith.
11. Governing law and disputes
3DP Ocean is a service of 3DP Miniatures (ABN 60 917 115 062), an Australian business. These Terms are governed by the laws of Australia, without regard to conflict-of-laws principles. Any dispute that can't be resolved informally will be resolved in the competent Australian courts. Where mandatory local consumer protection law applies (EU, UK, Australia), nothing in these Terms overrides those rights.
12. General
- What survives. If these Terms end, the parts that are meant to outlast them do: the licences you already hold in models you downloaded, anything you owe us or we owe you, and the sections on intellectual property, disclaimers, liability, indemnification and governing law.
- Events outside our control. We are not liable for a failure or delay caused by something we cannot reasonably control: an internet or hosting outage, a payment processor or AI provider going down, a natural disaster, war, or a change in the law that stops us operating. We will restore the service as soon as we reasonably can.
- If one part fails. Should any part of these Terms be held unenforceable, the rest stays in force and that part is read as narrowly as the law allows rather than struck out entirely.
- Transfer. You may not transfer your account or these Terms to somebody else. We may transfer them to a successor if the business is sold or reorganised, and your rights are unaffected by that.
- The whole agreement. These Terms, together with the Privacy Policy, Content Policy, Licenses and Cookie Policy, are the entire agreement between us and replace anything said beforehand. Not enforcing a term once does not waive it.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced via email or an in-app notice at least 30 days before they take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
